Player’s Club Terms & Conditions

These Terms and Conditions entirely govern your use of the Player’s Club Rewards Program (the “Program”) offered at Metropolitan Entertainment Group casinos in Nova Scotia (collectively, “Casino Nova Scotia”). Please review these Terms and Conditions carefully.

These terms and conditions are effective April 29, 2021 and supersede all prior Terms and Conditions. If you do not agree to any Terms and Conditions set out herein, or if you do not agree to any amendments made pursuant to these Terms and Conditions, you sole remedy is to cease participating in the Program and to cancel your membership.

Participation

To participate in the Program at a Casino Nova Scotia location (each a “Location”), you must be a member of the Player’s Club (a “member”) at either the Halifax or Sydney location. Applications for membership may be made at the Guest Services Desk of the Halifax or Sydney locations.

Applications for Membership

In order to participate in the Program, and to become a member of the Player’s Club, you must: (1) be 19 years of age or older; (2) not be inactive, trespassed or self-excluded from Casino Nova Scotia; and (3) not be an employee, officer, or director of Great Canadian Gaming Corporation or any of its affiliates or subsidiaries, including Metropolitan Entertainment Group. Valid, government-issued photo identification must be presented at the time of the application and each time a member redeems Reward Points (defined below). Casino Nova Scotia has the right to accept or deny any application for membership in the Player’s Club at its sole discretion.

Privacy

Accumulation of Reward Points

Player’s Club Reward point (“Reward Points”) will be awarded to members playing slot machines at a rate of one (1) Reward Point per six dollars ($6) played. When you are playing slots, your Reward Points will not accumulate unless you properly insert your membership card (your “Card”) into the machine and it indicates that your card has been accepted. It is the member’s responsibility to make sure their card is inserted properly as points cannot be awarded retroactively. Table games players must ask to be rated when they arrive at a game and present their Player’s Club card at that time. Reward Points at table games are calculated based on the game odds, length of play, speed of hands and average bet.

Notwithstanding anything else contained in these Terms and Conditions, Casino Nova Scotia reserves the right to at any time change or otherwise alter how Reward Points are recorded, accumulate or calculated in any respect, without notice to you.

Tier Qualification

With a photo ID, anyone 19+ can become a Bronze member of the Player’s Club
Qualification for premium tiers – Silver, Gold and Club Privé – is based on the Rewards Points earned in six months:
Points earned between December and May qualify players for their June-December status;
Points earned between June and November qualify players for their January-June status.

*Please note these timeframes may be suspended or paused due to the government mandated suspensions of operations related to COVID-19.

TIER — POINTS TO QUALIFY (EARNED IN 6 MONTHS)

Bronze: 0-1,999 points
Silver: 2,000 – 9,999 points
Gold: 10,000 – 39,999 points
Club Privé: 40,000+ points

Exclusion and Forfeit of Reward Points

If, in Casino Nova Scotia’s sole discretion, a member abuses any of the Program’s privileges, fails to follow these Terms and Conditions, or makes any misrepresentation, Casino Nova Scotia may, in addition to any other remedies available to it in law or in equity, revoke that member’s membership in the Program including forfeiture of all accumulated Reward Points.

Members who cancel their membership or have excluded themselves from membership pursuant to a self-exclusion program or have been banned from property will thereby forfeit all accumulated Reward Points and give up the right to receive any further Reward Points.

Expiry of Reward Points

Acquired Reward Points will expire and be deemed forfeited if not used within 24 months. Reward Points will be used on a first in, first out basis. All accumulated Reward Points may be forfeited, without notice, at Casino Nova Scotia’s sole discretion.

Furthermore, if any member does not acquire Reward Points for 18 consecutive months, the membership will be deemed to be inactive, and all accumulated Reward Points may be expired and deemed forfeited, without notice, at Casino Nova Scotia’s sole discretion.

Non-Transferability of Reward Points

Reward Points are personal to each member and are not transferable; furthermore, Reward Points cannot be sold, purchased, transferred or otherwise acquired except through participation in the Program. Reward Points accrued by a member are credited specifically to the member and cannot be transferred to any similar program at any other location operated by Casino Nova Scotia or its affiliates.

Use of Reward Points

Subject to these Terms and Conditions, Reward Points may be used by redeeming them for specific goods or services designated by Casino Nova Scotia from time to time collectively, “Rewards”, at a rate of $0.01 per Reward Point. Notwithstanding these, Reward Points have no cash value except as designated by Casino Nova Scotia from time to time.

At this time, Casino Nova Scotia offers two types of Rewards: using Reward Points for casino cash and ticket in/ticket out (TITO) (“Cash Back Rewards”); and using Reward Points for select food and beverage, accommodation or other goods and service providers designated by Casino Nova Scotia (“Benefits”). Casino Nova Scotia reserves the right to determine or alter, with or without notice, the Rewards for which Reward Points may be redeemed. Reward Points cannot be applied to other promotional offers by Casino Nova Scotia unless so indicated by Casino Nova Scotia.

In order to redeem Reward Points for a Cash Back Reward, a minimum of 1,000 Reward Points (equivalent to $10) is required. Players can download points with an accumulated total of as little as $1 or 100 points. Subject to that minimum, Reward Points may be redeemed for Cash Back Rewards in 100 Reward Point increments only (equivalent to $1 increments only) up to a maximum of 50,000 Reward Points ($500) in a 24-hour period. Casino Nova Scotia may, at its sole discretion, allow the exchange of Reward Points greater than the daily maximum.

Members may request Reward Point balances at the Guest Services Desk at either Location. Valid government issued identification is required to check balances. Given the confidential nature of the calculation of the accrued rewards, Reward Point balances are deemed correct when issued by Casino Nova Scotia. If there is any dispute, disagreement or discrepancy regarding Reward Points, a written notice must be made to Casino Nova Scotia, whose decision regarding any such dispute, disagreement or discrepancy will be final and binding and will prevail in all respects.

Members playing more than one spot can insert their Cards at multiple slot machines / electronic table games, at the discretion of the staff at Casino Nova Scotia. The maximum number of machines that a single member can play simultaneously is limited to three (3) but can be limited to one (1) at the discretion of Casino Nova Scotia staff. It is the member’s responsibility to ensure that each session is properly rated (i.e., the Card is properly inserted into the slot machine and accepted for play). A member’s account can only be used by the named account holder and may not be used by any other individual or entity.

All earned points are the property of Casino Nova Scotia until they are redeemed by the guest and can be forfeited, or used to cover any damages to property, issues of theft, etc. at Casino Nova Scotia’s sole discretion.

Benefits

Players can qualify for additional benefits based on their tier status. Benefits are defined by Casino Nova Scotia and may be changed or cancelled at any time. A list of current benefits can be found at Guest Services at either Location.

Opting In

If you have elected not to opt-in to receiving Electronic Communications, or opt out of Direct Mail, you will still have access to the benefits and rewards of the Program by utilizing your Player’s Club Rewards card while on property. You will not receive additional offers and rewards via Electronic Communications and Direct Mail, but you may receive other communications related to the Player’s Club Program. You may check your status of enrolment in these communications, or opt-in or opt-out, any time by visiting Guest Services at either Location. Lost Card

Casino Nova Scotia will not be responsible for lost, stolen or destroyed cards. Lost, stolen or destroyed cards must be reported to the Casino Nova Scotia guest representative desk. Casino Nova Scotia, in its sole discretion, may or may not replace lost, stolen or destroyed cards.

Amendments

Casino Nova Scotia reserves the right to amend the Program, and these Terms and Conditions, at any time immediately upon notice to you, and your continued participation in the Program after such amendments will be deemed to be your acceptance thereof, except that such amendments will not apply in respect of disputes then in existence between Casino Nova Scotia and any person, including members.

Casino Nova Scotia may restrict, suspend, change or otherwise amend the Program and any aspects or part of it, with or without notice at any time and, when doing so, will post notice thereof on its website and at its Guest Services Desks. After any such amendment, your continued participation in the Program will be deemed to be your acceptance thereof.

Notwithstanding the foregoing, Casino Nova Scotia will give 10 days’ notice posted in Casino Nova Scotia locations and on Casino Nova Scotia’s website before terminating the Program. However, upon such termination, all memberships in the Program will be automatically revoked, including the expiry and forfeiture of all accumulated Reward Points.

Liability and No Warranties

Notwithstanding anything else in these Terms and Conditions, to the maximum extent permitted by applicable law, in no case will (a) Casino Nova Scotia and its parent and affiliate corporations (including Great Canadian Gaming Corporation), and their respective directors, officers, employees, servants and representatives (collectively, the “CNS Entities”) be liable to you or any person for any indirect, incidental, special or consequential claims, losses, expenses or costs of any kind whatsoever and however caused, whether arising under contract, tort (including negligence) or otherwise, even if any CNS Entities have been notified of the possibility thereof or could have foreseen them, or (b) the CNS Entities’ aggregate liability for direct damages in respect of the Program exceed the value of the relevant member’s properly-accumulated Reward Points pursuant to the provisions of this Agreement or $50, whichever is higher.

The Program is provided on an “as-is” and “as-available” basis, and Casino Nova Scotia expressly disclaims all conditions, warranties and representations, express, implied or statutory, including implied conditions, warranties or representations in respect of quality, conduct, performance, reliability or availability, in connection with the Program, whether arising by usage of trade, by course of dealing, by course of performance, at law, in equity, by statute or otherwise howsoever, to the maximum extent permitted by applicable law.

EACH MEMBER IS SOLELY RESPONSIBLE FOR ALL ACTIONS THAT TAKE PLACE UNDER THEIR ACCOUNT (WHETHER OR NOT SUCH ACTIONS TAKE PLACE WITH OR WITHOUT THE MEMBER’S KNOWLEDGE OR CONSENT). EACH MEMBER IS SOLELY RESPONSIBLE FOR ENSURING THAT THEIR ACCOUNT, CARD AND PERSONAL IDENTIFICATION NUMBER ARE KEPT SECURE AT ALL TIMES.

General

Your card is the property of Casino Nova Scotia and may be unilaterally revoked at any time by Casino Nova Scotia in its sole discretion. Your card is not a credit card.

Reward Points cannot be collected or redeemed by any business, organization, entity or any person other than the individual who is an active member of the Player’s Club. The Program and these Terms and Conditions will be governed by and construed in accordance with the laws of the Province of Nova Scotia and the laws of Canada applicable therein, without reference to conflict of laws principles. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, illegal or otherwise unenforceable, the same will not affect the other terms or provisions hereof or the whole of these Terms and Conditions, but such provisions will be deemed modified to the extent necessary to be enforceable.

The employees, directors or officers of Great Canadian Gaming Corporation and its subsidiaries, including, but not limited to Casino Nova Scotia, and their spouses are not eligible for membership in the Player’s Club or participation in the Program.
